A Los Angeles County deputy sheriff is facing up to 10 years in federal prison after being found guilty of excessive force against a woman outside a supermarket, officials announced Thursday.
The incident took place on June 24, 2023, in the parking lot of a WinCo Foods store in Lancaster. Deputy Trevor James Kirk, 32, of Santa Clarita, was investigating a shoplifting report when he detained a man who fit the suspect’s description. Meanwhile, a woman identified as J.H. by the U.S. Department of Justice, who resembled the description of a female suspect, began recording the interaction on her cellphone.
According to a DOJ statement, J.H. informed Kirk that he was legally required to explain to the male detainee why he was being held and mentioned that she was live-streaming the footage.

Instead of responding with verbal instructions, Kirk attempted to seize J.H.’s phone. When she turned away, he grabbed her arm, placed his left hand behind her neck, and forcefully threw her face-first onto the pavement, the DOJ stated.
After pinning her down with his knee on her shoulder, Kirk allegedly threatened her, saying, “Stop or you’re gonna get punched in the face.” Prosecutors further stated that he then placed his knee on her neck while she protested, saying, “Get your neck… off my… I can’t breathe.”
At one point, Kirk radioed for backup, falsely claiming he was engaged in a fight. He then pepper-sprayed J.H. twice, even though she was holding only a pair of prescription sunglasses and a cloth surgical mask in her hands, according to the DOJ.
J.H. sustained multiple injuries, including blunt-force head trauma and wounds to her arms and wrists. The effects of the pepper spray also required medical treatment.
Kirk is scheduled for sentencing on April 21 and could face a maximum of 10 years in prison.
