Americans Could Claim Payout in $6M Cold & Flu Medicine Settlement

Consumers who purchased certain Zicam cold and flu relief products may have been eligible for a payout from a $6 million class-action settlement—though the deadline to file a claim has already passed.

The lawsuit, filed in Illinois, accused the manufacturer, Church & Dwight, of misleading consumers with claims that Zicam products were clinically proven to reduce the duration and severity of colds. While Church & Dwight has denied any wrongdoing, the company agreed to a settlement that includes financial compensation for eligible customers and changes to product labeling.

Who Was Eligible for a Payment?

Individuals across all 50 states who bought a Zicam product before October 17, 2024, were included in the settlement.

  • With proof of purchase: Consumers could receive $5 per product for up to six items, totaling a maximum payout of $30 per household.
  • Without proof of purchase: Shoppers could still claim $2.50 per product for up to two items, meaning a maximum of $5 per person.

A portion of the settlement—up to $2 million—was allocated for attorney fees and legal expenses. Additionally, select class members were eligible for a $3,000 service award if approved.

Changes to Zicam Product Labeling

Beyond financial compensation, the settlement also required Church & Dwight to modify Zicam packaging. Any statements suggesting that the products shorten colds or lessen symptoms must be revised within 36 months of the settlement approval.

Key Deadlines and Final Hearing

  • Objection Deadline: Consumers who disagreed with the settlement terms could submit objections by December 18, 2024.
  • Claim Submission Deadline: The deadline to file for a payout was January 17, 2025.
  • Final Hearing: The court is set to hold the final approval hearing on February 28, 2025.

Class members were not required to attend the hearing in person, as legal representatives would handle the proceedings.

Missed the Deadline? Here’s What That Means

If you did not file a claim before the deadline, you will not receive any compensation from this settlement. However, the changes to Zicam product labeling will still apply to future purchases .
